What to Expect - Understanding The Process
The recall process is an important way for members to voice concerns and hold board members accountable when they are not fulfilling their duties to Power Ranch. Here’s a breakdown of how the process works, from petition to vote:
-
The recall process begins when a group of Power Ranch members submits a petition to recall one or more Board members. The petition must include:
Names of the Board members being considered for recall.
Name of the petitioner (must be a member of the association).
Physical address of the property within the association that the member owns.
Signature of support from the member.
Date of signature.
Signatures will be verified for:
Validity: The signer is the property owner listed - one signature per property address.
Standing: The signer must be in good standing with their dues and membership rights on the date of signing (eligible voter).
Once the required number of signatures is collected and verified, the petition moves forward.
-
After the petition is verified, Management will review it to ensure:
It meets legal standards.
The necessary number of signatures from eligible Power Ranch voters has been obtained.
-
Once the petition is validated, the Board must hold a recall vote within 30 days of receiving the validated petition.
A notice will be sent to all Power Ranch members at least 10 days before the meeting and must include:
Details about the recall and the names of the board members being recalled.
Voting instructions, including the time, place, and method of voting (e.g., in person, electronically).
-
During the scheduled voting period, members will vote on whether to recall the board member listed in the petition. The ballot will allow voters to:
Vote to recall or retain each of the board members (Ken Starks, Anh Jung & Katharine Wick).
Voting will occur in person and electronically.
-
Once voting concludes, the votes will be counted. Arizona law stipulates that the recall of each board member is successful only if a majority of the voting members cast their votes in favor of the recall.
Quorum Reached: 20% of Power Ranch’s eligible votes are required to reach quorum.
Recall Approved: If the majority votes in favor, the board member(s) will be removed immediately.
Recall Denied: If the majority votes against the recall, the board member(s) will remain in office, and no further action will be taken.
